Layoffs Can Mean Lawsuits

It’s not just company performance during recessionary times that worries business owners and top management. With layoff numbers rising every week, employee lawsuits are rising in step. Former Lehman Brothers employees filed suit, claiming they were never given the required 60-days’ notice before they were let go and Dell is currently being sued over alleged age and sex discrimination against former employees after they went through with a mass layoff.

Lawyers across the country are reporting a never-before-seen rise in cases. Most of those cases are brought about by laid off workers who allege their former employer did not follow the government-mandated Worker Adjustment and Retraining Notification (WARN) Act, which requires larger employers to provide 60 days’ notice of plant closings or mass layoffs.
