4 Trends in AI Governance for 2026

AI has been the subject of public debate for many years. This year should see some clarity, however. With the EU AI Act going into full effect in August and state-level bills in the United States—Colorado’s already passed, and California and New York are advancing similar frameworks—AI management will no longer be limited to declarations. Instead, AI management is becoming an infrastructural function embedded into how organizations operate, and these four key shifts will define AI governance in 2026.

1. AI Regulation Maturity and the Rise of Shadow AI

For years, many leaders have been discussing their organization’s approach to AI and trying to figure out how to best regulate or monitor it within the organization. Indeed, some have even published formal documents on responsible AI use and the organization's plans. However, with the new laws being enacted in 2026, organizations will have to answer to regulators that increasingly expect verifiable technical evidence, not verbal claims.

When the EU AI Act goes fully into effect in August, it will introduce the first unified, comprehensive AI regulatory framework to date. This marks the beginning of AI regulatory maturity, which will accelerate rapidly across jurisdictions. One immediate consequence is that since the EU AI Act is based on documenting AI system inventories, this will become a core compliance function for many EU-based companies.

Organizations will need to demonstrate what types of AI models they use, what data those models rely on, how decisions are made, who is accountable for risk management, and how quality and performance are monitored. This framework will challenge many organizations that lack visibility into their AI usage. Consequently, shadow AI becomes a serious risk because compliance will be impossible if organizations do not know which AI tools employees are using. Employees adopting AI tools outside approved channels will become a growing concern for auditors and regulators.

2. Audit Expectations Shift to Technical Evidence

In the current regulatory landscape, only the most mature AI teams document their models systematically. When these new laws go into effect throughout 2026, that will become both the norm and a regulatory requirement.

First, AI model cards will be required during audits. A model card documents a model’s architecture, intended use, performance metrics, risks, limitations and training data characteristics.

Second, data lineage will move firmly into audit scope. Data lineage tracks the full lifecycle of a model’s data, including its sources, transformations, access controls and usage by the model. It maps the relationships between a model and all components that contributed to its development. This is especially critical for high-risk AI systems; it is impossible to ensure the security or integrity of a model without understanding how data flows through it.

As a result, organizations will need to maintain centralized catalogs of AI models, track versions, document risks and establish formal governance processes for model changes.

3. Shift from Visibility Gaps to Deep Model Understanding

Regulators will increasingly require organizations to provide evidence that explains why AI made a particular decision and what factors can impact the outcome. Explainability refers to the ability to understand how and why an AI system makes a particular decision. It will be especially needed in credit scoring, insurance, HR, healthcare, public services and fraud prevention. In 2026, it will become a standard operational requirement, especially for high-risk or regulated use cases.

To address this, organizations will need to integrate explainability methods such as SHapley Additive exPlanations (SHAP), Local Interpretable Model-Agnostic Explanations (LIME) and counterfactual analysis into production pipelines, provide clear insights for each automated decision, and detect and document bias if it occurs.

4. Focus on Continuous AI Quality Assurance

As AI systems move from development to production environments, organizations face another challenge: monitoring AI to ensure ongoing quality. Because poor AI quality can lead to material risks, regulators will increasingly expect continuous oversight. For example, a credit-scoring model may systematically misjudge applicants from emerging demographic segments if it was not adequately trained on representative data.

Organizations will need to track model drift, which occurs when the statistical properties of production data diverge from the data used during training, reducing model accuracy. For instance, a loan-approval model trained on pre-recession economic data may encounter fundamentally different applicant profiles during an economic downturn, indicating a shift in input data distribution. In addition to data drift, organizations must watch for concept drift, where the relationship between input features and outcomes changes over time, as well as upstream data drift, where changes in data collection or processing alter incoming data characteristics without any real-world change.

Another critical risk is performance degradation. A customer service chatbot that once resolved 85% of inquiries autonomously may gradually decline to 70% as new products launch, policies evolve and customer language changes. Performance degradation is particularly dangerous because systems often continue operating well enough until significant harm has already occurred.

To detect and prevent these issues, organizations need baseline performance metrics, continuous monitoring of prediction behavior, validation datasets to identify drift early, and comprehensive logging of accuracy, response times and confidence calibration across different data segments and time periods.

This year, AI management and compliance will become technical disciplines with clear operational obligations. To prepare, compliance teams must deepen their technical understanding of how digital systems behave in practice. Risk and compliance roles will increasingly need to be able to translate technical complexity into accountable, auditable governance. When executed effectively, AI governance can become a business enabler, serving as a bridge between technical teams, compliance functions and business leadership.
